It would be but unless you're a lawyer and have a ton of free time on your hands it ain't gonna happen.
To get a lawyer interested you either pay him or give him hope he'll get a really big payoff. With a class action you're banking on the latter.
So the lawyer looks at the case from a couple of angles - is he likely to win or at least be able to extract a settlement to avoid protracted litigation? If he thinks that he's got a case or a target who will pay for him to go away, then he asks - does the target have big money? The target doesn't need to have money themselves but could be someone with lots of insurance to drag into the suit.
If the answer to the "is there money" is no, then there's no lawsuit. The lawyer picks another case.
That's where we are with Jon. There used to be lots of money. Now after years of trips around the world, multiple build partners, factory starts & stops, designs & redesigns, employees coming & going and living offshore, it's unlikely there's any money left.
So we could look to his business insurance and try to prove fraud or other acts of mis- or malfeasance and then get the insurance money. But with the extraordinary level of business incompetence that he exhibited from the start - ignoring the advice of many who have actually done something like this before, I'd hazard a guess there's no insurance.
Jon's not going to pay for any of this.
